What is the Labor Board ?

If you are currently working for an employer who refuses to pay your vacation pay,  overtime,  cheating  you on your hours, or commisions,   The Labor Board is there to help you.   Below find a office nearest you.

You can make a complaint on line or visit your local office.  I suggest going in person.  Bring all your employer information, names of owners, managers ect.., Pay Stubs, any documentation prooving your claim.  Once there you will approach the window and explain your situation, the intake person will guide you with the proper procedure and give you the appropriate forms to fill out while you there.  After you fill out the forms you hand them in and they process your complaint and go to work for you.  They contact your employer, and give them a deadline to respond, if they dispute your complaint and refuse to pay you, the  officer assigned to your claim will schedule a hearing at that time you ,and the employer along with  the officer will sit down together and both you and your employer have an opportunity to state your claims.  The officer then decides if monies are legally owed to you and demand a payment from the employer on your behalf.

NOTE *****  You generally have 45 days from the day the discrimination occurred to file a complaint with the EEOC Check your States office rules for filing.

 

NOTE ***** You can find an Employment lawyer specializing in Discrimination in the Work Place, and he can file the complaint with the EEOC on your behalf, or if you contact the EEOC first, while waiting for their response ,  start shopping for the right attorney and visit at least 3 who specialize in that area of law.  If you enter a law suit it is important to like and trust the attorney you are working with.  Do not assume that if the EEOC does not find a violation that you have no case,  Employers have an opportunity to respond to a complaint, and although they are required to tell the truth, not all do , If you feel strongly about having a  case, do your own investigation, get the facts, the proof, talk with  Co-workers if you find someone  willing to help you, and witnessed or saw the discrimination that will be a great help, and  you can file a claim in the Federal District Court in your County within 90 days yourself even without an attorney.

 

NOTE **** If the EEOC did not find a violation of the law, they will send you a Notice-of-right-to-sue.  This notice gives you the permission to file a lawsuit in a Court of Law, if they find a violation, they will try to reach a voluntary settlement with the employer.  If they cannot reach a settlement , your case will be referred to their legal staff who will decide whether or not the agency should file a lawsuit.
