Dont Assume the Judge assigned to your case has experience in Family Law.  Judges where once attorney’s but they may not of practiced in the area of inFamily Law.

With that being said, Judges  rely on Attorneys to keep them up to date on changing laws or recent  cases that have precedent, which is a court decision that is cited as an example to resolve similar questions of law in later cases.

It is up to the Attorney you hire to present the updated laws & most recent cases that can be used in your case. It is important to ask questions to your attorney about these issues. You cannot assume he has taken the time, to research or properly convey all the special aspects of your case to the judge weather in his written documents or orally inCourt. We as customers just assume.  In my experience very rarely do Attorneys even use case law in family court matters.  Really it is all negotiations, with the 2 Attorney’s and the Judge.  Yes they follow the Law, Yes they comply with all Court Rules & Procedures , but really after all is said and done the main goal is to solve all disputes fairly between the parties and enter into an agreement on each  issue before they get in front of the judge, and when the two parties can’s work it out then a 3rd party decides and that 3rd person is the Judge.  Very rarely do family law cases ever go to Trial.  You may think it will get there but after all the time, money spent it is settled before that point.   It is all really so simple, the parents make it complicated buy insisting there way or the highway.

The decisions and rulings the Judge makes effects yours and your children’s lives, for years to come,  and his decisions cannot be reversed. Maybe Appealed but even that could takes years.

You must  have the upmost respect for our legal system, and our Attorneys that practice law, also the judges who hear our cases, but unfortunately there are always stories of good people who hired good lawyers and the outcome was not what they had hoped for.

 

This is a fact:

You have one shot to get it right.  You can trust no one with your families life.  You can not assume all attorneys are looking out for your best interests, you can not assume they are taking the time on your case when they only get paid by the hour,and have multiple cases going on at any one time. You can not assume that the judge who hears your case is truly looking out for yours or your children’s best interests.  They hear hundreds of cases each and every week, and multiply that by how many cases heard in 1 year !  You can get a Bio  on most judges, check out your Courts website to see if they offer this information.   If you have the time, you should find out the judges schedule who is assigned to your case,  and sit in on a few of his court cases.  This will give you insight on his or her demeanor, expectations and a perhaps a pattern of how he or she rules on certain aspects of a case.

 

Get Involved early, demand better communication with your attorney, don’t let him decide what is best, deals are worked behind closed doors everyday in the Court House.  Remember you are paying him or her to represent you.  He or she should not have the attitude that you have no say so in what goes on in your case.  If you have an attorney you feel is not following your direction of what you feel is right, let him go, and find another one who is willing to listen and follow your wishes there are plenty out there who would love to be hired to represent you.

Most all Attorneys hired want a set fee up front.  Most cases $3,000-$5,000.  Why ? they are protecting their own interests , they know that disputes between clients and attorneys happen, they know that they can be fired at any time, if one of the two should happen they have your money.  Legally they will have to send you a bill and you have no recourse to dispute, hours , charges or fees.

Believe me this is a common scenario.  The hours they bill clients are in almost all cases inflated, every phone call , filling, or court appearance they have the upper hand, you have no way to dispute cause you have know way of knowing what they are actually doing or how long it should take.

If at all possible try to avoid this method of payment.
